Heard the learned Advocate for the Applicants and the learned APP for the State. Perused the papers. 2.
Apprehending arrest in connection with Crime No. 0406 of 2025 registered with Sailu Police Station, District Parbhani, for offences punishable under Sections 4 and 25 of the Arms Act, 1959, Section 135 of the Maharashtra Police Act, 1951 and Sections 109, 115(2), 118(1), 118(2), 189(2), 189(4), 190, 191(2), 191(3), 351(2), 351(3) and 352
2 902ABA1526.2025.odt of the Bharatiya Nyaya Sanhita, 2023, the Applicants have approached this Court by filing the present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking Anticipatory Bail. 3.
The Crime has been registered for the incident of assault by more than twenty-one [21] persons on the morning of 04.08.2025 on account of the use of a bandh road leading to the agricultural field. There is a counter FIR by the other side for the same incident. There is Injury Certificate, which shows that the persons, who were beaten by the FIR-named accused, suffered both simple as well as grievous injuries. As far as the present Applicants are concerned, omnibus allegations of assault by slaps and fists are made against them. The allegations of assault by deadly weapons are attributed to the Co-accused, who are Accused Nos. 1 to 7 in the FIR, who are not the Applicants in this Application. In this view of the matter, I am inclined to grant pre-arrest bail to the Applicants. Hence, the following order:
ORDER
[i] The Application is allowed.
[ii] In the event of arrest of the Applicants, namely, Pandharinath Dhondiba Ghule, Deepak Haribhau Sanap, Bajarang Shrirang Nagare, Ashok Dattarao Ghule, Parashram Dattarav Ghule, Udhav Laxmanrao Ghule, Vithabai Parashram Ghule, Savita Pandurang Ghule,
3 902ABA1526.2025.odt in connection with Crime No. 0406 of 2025 registered with Sailu Police Station, District Parbhani, for offences punishable under Sections 4 and 25 of the Arms Act, 1959, Section 135 of the Maharashtra Police Act, 1951 and Sections 109, 115(2), 118(1), 118(2), 189(2), 189(4), 190, 191(2), 191(3), 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023, they be released on bail on their furnishing P.B. of Rs. 15,000/- [Rupees Fifteen Thousand] each, with one surety in the like amount.
[iii] The Applicants shall attend Sailu Police Station, District Parbhani, on every Saturday between 02:00 pm to 06:00 pm, till the Charge-sheet is filed. They are further directed to co-operate with the Investigating Agency.
[iv] The Applicants shall not tamper with the evidence in any manner whatsoever.
[v] The Application stands disposed off.
