The petitioner / original complainant before the District Collector, Nanded is aggrieved by the interlocutory order passed by the Additional Divisional Commissioner, Aurangabad dated 09/08/2019. Respondent Nos. 5 to 7 have been disqualified by the order of the District Collector dated 03/07/2019. They approached the Additional Divisional Commissioner and prayed for ad interim protection. By the reasoned order dated 09/08/2019, the appellate authority has granted protection to these three persons from disqualification and the proceedings are now posted on 19/10/2019 for

Notwithstanding the contentions of the learned Advocate for the petitioner, I find that an equitable order has been passed by the authority below. All the litigating sides are at liberty to advance their final arguments on 19/10/2019 and the Additional Divisional Commissioner can thereafter decide the said proceedings by delivering its order, preferably within 45 days.

In view of the above, this petition, being devoid of merit is, therefore, dismissed.
