The grievance of the petitioner is that, the approval is granted to the appointment of the petitioner as a peon on probation period. Subsequently, the proposal is filed for granting approval for continuity in service. No orders are passed by the Education Officer.

The Education Officer has filed affidavit to the effect that the proposal is not found in the office of the Education Officer and that there are surplus peons.

The position as on the date the petitioner became permanent will have to be considered.

The management shall forward the proposal of the petitioner afresh along with all relevant documents including earlier order of appointment of the petitioner to the Education Officer. The Education Officer shall within a period of six (06) months from the date of receipt of the proposal from the management seeking approval to the continuity of the services of the petitioner shall take decision upon it on its own merits, in accordance with law.

In the light of the above, the writ petition is disposed of. No costs.
