The petitioner had applied to a seat reserved for a specific scheduled caste while taking admission through MH-CET 2023 and was unable to produce the certificate of validity by the cut-off date i.e. 17.08.2023. The authorities treated her admission as cancelled and adjusted her against a seat under 'Open' category. Subsequently, she was able to obtain a certificate of validity and is now requesting that she should be considered as admission against a reserved seat, in all probability and as submitted by her learned advocate, to enable her to claim various benefits of different government schemes including the

2 948..odt scholarships and free seats.

In our considered view, if this is the only reason as to why the petitioner has been seeking to migrate back to the reserved seat, it would be appropriate for her to first take steps for claiming the benefits which she intends to derive. It is only thereafter her request can be considered.

Writ petition is disposed of with liberty to the petitioner to apply for all the benefits she intends to derive and if need be approach the Courts of law again.
