This is an application for speaking to the minutes of the order dated 19.11.2025, passed by this Court. 2.

Learned Advocate for the applicants pointed out an order dated 19.11.2025, passed by this Court, by which, this Court has permitted the applicants to withdraw the amount of interest on the amount of Rupees One Crore Six Lakhs and some odd amount which stated to be already withdrawn. According to the learned Advocate for the applicants, the interest amount is near about 39,00,000/-. He further submitted that this Court had already directed that a sum of Rs.1,00,00,000/- be placed in fixed deposit in the names of the two claimants, who are minors aged about 9 and 12 years. He therefore prayed to allow the applicants to withdraw the interest amount for their regular need as, they are pursuing eduction.

On perusal of the earlier order, it appears that an amount of nearly Rs.6,00,000/- has been allowed to be withdrawn by the grand parents of the minor claimants. Therefore, it would be proper to allow them to withdraw the half of the interest amount on furnishing the usual undertaking. Hence, the following order:

ORDER

a.

Applicant nos.1 and 2 are permitted to withdraw half of the interest amount deposited in this Court to the extent of their share and applicant no.3 and 4 being major, they are entitled for interest amount of their share independently on furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.

Applicants are also permitted to withdraw the remaining half of the interest amount alongwith interest accrued on it after four years.

The Learned M.A.C.T., Shahada-Nandurbar is directed to allow to pay the monthly interest on the amount of 1,00,00,000/- to the minor claimants/applicant nos.1 and 2 till the final decision of the appeal by issuing intimation letter to the bank with the copy of this order.

The Applicants shall submit two copies of this order before the learned M.A.C.T. Shahada.
