The learned counsel appearing for the appellant made a statement across the bar that he received a Communication dated 07.05.2024 from appellant in response to letter dated 02.05.2024 issued by him. The appellant stated in his Communication that the decree already executed and he handed over possession of the suit property.

In view of the above, nothing survives in the present appeal, hence, it is dismissed. No order as to costs. [ 4.
