The petitioner is challenging the order of invalidation. 2.

Considering the exigency, we have heard both the sides finally. 3.

It transpires that admittedly the petitioner's sister had faced invalidation. However in Writ Petition No.6764/2023, by the order dated 01.09.2023, she was held entitled to have certificate of validity subject to certain conditions.

Since the petitioner's claim has been decided by permitting him to adopt the reply filed by his sister to the vigilance inquiry report, like her, even he would be entitled to have a validity of certificate subject to the same conditions. We, therefore, pass the following order :

ORDER

i.

The writ petition is partly allowed.

ii.

The impugned judgment and order dated 14.08.2024 passed by the Scrutiny Committee is quashed and set aside. iii.

The Scrutiny Committee shall immediately issue validity certificate to the petitioner as belonging to 'Koli Mahadev' scheduled tribe.

iv.

The validity certificate shall be subject to outcome of reverification undertaken by the Scrutiny Committee. v.

The certificate of validity shall be issued in the prescribed format without incorporating any conditions/additions. vi.

The petitioner shall not claim any equities.
