ORDER :

The application is filed for bail. Both the sides are heard.

This is the second application for bail. Charge-sheet is filed against the accused for offences of rape, abduction, girl trafficking, etc. This Court has refused bail to the present applicant for many reasons which include presence of strong evidence against him, the possibility that he may abscond as he is resident of other State and there is possibility of tampering with the prosecution witnesses. There is allegation against the applicant and others,, who are from Rajasthan that they paid money for purchasing the prosecutrix from her relatives and then they took her to Rajasthan where she was raped by many persons including present applicant. This Court has made
Cri. Appln. No. 5107/2016 observations with regard to the circumstances due to which such incidents are taking place. The circumstances are not changed and there is still possibility of absconding of the accused and there is also possibility of tampering with the prosecution witnesses. Direction can be given to the Trial Court to expedite the matter and only that thing is possible in the present case. 3.
The learned counsel for applicant submitted that one brother, who was also accused and who was absconding, is no more as he was murdered and his father is also dead. This circumstance cannot make any difference for which the applicant can get bail.

So, the application is rejected. The Trial Court is expected to disposed of the matter and in any case, within six months from the date of receipt of this order. [ T.V. NALAWADE, J. ] ssc/
