Mr. Chavan, learned counsel appearing for the petitioner on instructions of the petitioner seeks leave to withdraw the petition with liberty to issue notice to the plaintiff for production of original document being bond executed on 26.09.1986. Depending on the response of the plaintiff to such a notice, he seeks liberty to file such application as may be necessary in respect of that document.

If, such a notice is indeed issued and application is filed, the same shall be decided without being influenced by the observations made in the order dated 24th August, 2022. 3.

With these observations, the petition is allowed to be withdrawn and disposed of. All points on merits in this regard are kept open.
