The petitioner challenges the order of the Maharashtra Administrative Tribunal (MAT), holding the petitioner's application to have not been filed within a period of limitation and with a direction to file an application for condonation of delay. 3.

In original application, following are the reliefs claimed : "(A) The impugned order/communication dated 22.03.2022 (Exh. 'A-6') addressed to the respondent No.3 i.e. the Superintendent of Police, Beed by the office of Respondent No.2 i.e. the Superintendent of Police, Nanded is hereby quashed and set aside.

(B) The respondent No.2 is directed to allow the applicant to join his duties as per transfer order dated 16.03.2022 (Exh. 'A-4') immediately and to take necessary steps in accordance with law to pay unpaid salary of the applicant since the date of transfer i.e. on 16.03.2022 or 21.03.2022 within the period of one month from the date of this order."

During the course of hearing, learned advocate for the petitioner comes around to withdraw prayer clause (A), since according to him, the same is the prayer consequential to the grant of relief prayed in prayer clause (B).

Since the learned advocate for the petitioner has withdrawn prayer clause (A), in our view, nothing survives in the matter. The matter stands relegated back to the Maharashtra Administrative Tribunal (MAT) to consider the same on its own merits within a period of 9 months from today without racking up the issue of limitation.
