The learned AGP submits that against the impugned order, the revision before the State is maintainable. In view of the submission made by the learned AGP, the learned counsel appearing for the petitioner seeks leave to withdraw the present writ petition with liberty to approach the revisional authority. However, he submits that the time taken in prosecuting the present matter be excluded in computing the period of limitation in applying of the revision.

Having considering the submissions, the Writ Petition is dismissed as withdrawn with liberty as prayed above i.e. if the revision petition is filed within four (04) weeks the time taken in

2 23 prosecuting the present remedy would be excluded in computing the period of limitation in filing of the revision petition. 3.
