Heard Mr. Barde, the learned Advocate for the petitioner. 2.

Mr. Barde, the learned Advocate submits that the impugned communication dis-entitles the petitioner for pensionary benefits. According to the learned Advocate, the State Government has provided the benefit of pension but the Central Government has not extended the said benefit. According to the learned counsel, the Central Government also deserves to observe parity to the State Government. 3.

In the impugned communication, it has been observed that the employees of Ahmednagar College are neither employees of National Service Scheme nor the employees of Department of Youth

910wp51-22 Affairs. As such the pensionary benefits are not provided to such employees.

In absence of any rules, executive instructions entitling penesionary benefits, the relief cannot be granted to the petitioner. As such the writ petition is disposed of. No costs. (GAURI GODSE, J.) ( ACTING CHIEF JUSTICE ) JPChavan
