Heard learned Advocate for the petitioner and learned AGP for respondent Nos.1 to 4.

It appears that the learned Member of the Maharashtra Administrative Tribunal, Aurangabad has decided the interim application and it has been specifically observed that the learned Advocate for the applicant i.e. present petitioner has failed to point out any provision of law or case law to support the submissions. Under such circumstance, the learned Advocate for the petitioner now submits that though the learned Member, Maharashtra Administrative Tribunal had given directions to respondent No.3, the appellate authority, to decide the departmental appeal preferred by the present petitioner at the earliest, it has not been so decided and therefore, now he seeks that directions be issued to the appellate authority to decide his appeal at the earliest.

In view of the failure on the part of the petitioner to show any provision of law to support his submission, the only thing can be observed in his favour, would be that the directions can

be issued to the appellate authority to decide the departmental appeal preferred by the petitioner on 21st April 2022 to its earliest i.e. within three months. With these directions the Petition stands disposed of.
