Heard learned Advocates for the parties. The applicant-wife has filed this application for transfer of matrimonial proceeding bearing HMP No. 160 of 2021, pending in the Court of Civil Judge, Senior Division, Ambajogai, to the Family Court, Aurangabad. 02.

It is submitted that the applicant is staying with her old aged parents at Aurangabad and their financial condition is not sound. The distance between the two places is about 250 kms. There is no body to accompany the applicant to attend the proceedings at Ambajogai. Therefore, it is prayed to transfer the proceedings from Ambajogai to Aurangabad.

Learned Counsel for the respondent submits that the

( 2 ) mca271.23 respondent has no any objection if the matrimonial proceeding is transferred to Aurangabad.

Considering the above, following order :-

ORDER

i.

This Civil Misc. Application is allowed in terms of prayer clause (A).

ii.

The applicant shall not seek unnecessary adjournments in the Trial Court. If the Trial Court finds that the adjournments are unnecessarily sought by the applicant-wife, the Trial Court shall pass appropriate orders, compensating the respondent-husband, if he personally remains present in the Court.

iii.

After transfer of the proceeding, the learned Trial Court shall make endeavour to dispose of the matrimonial proceeding as early as possible and preferably within eighteen months from the date of the transfer. [KISHORE C. SANT, J.] snk/2025/feb25/mca271.23
