Notice. Learned counsel Mr. K. Sawangikar, waives for respondents no. 8, 9 and 10. AGP waives notice. 2.
Small point is involved in the matter. The order of stay made by the learned Additional Commissioner, Aurangabad in appeal filed by the persons who are disqualified. The disqualification order was made on 13/05/2016. When under section 16 of Village Panchayat Act the appeal is required to be filed within fifteen days before the commissioner and it needs to be disposed of expeditiously, it appears that, the stay came to be granted on 26/08/2016 and the next date is given for hearing on 19/10/2016. When there are such disputes and appeals are filed the authorities are expected to expedite the matter. This court is avoiding to touch to the merits of the matter but it needs to be observed that such longer dates are not expected to be given in the appeals, disputes as on the basis of the record the matters are required to be decided as early as possible.

This court holds that the purpose of both the sides will be served if the authorities are directed to expedite the hearing of the appeal. Both the sides are hereby directed to appear before Additional Commissioner, Aurangabad on 26/09/2016 and within one month thereafter the appeal is to be disposed of by the Commissioner.
