The learned Advocate for the petitioners submits on instructions that both these matters have been settled between the parties. He places on record a copy of the application Exhibit-109 dated 03.12.2014 in Summary Suit No.118 of 2010 in between the petitioner Lokseva Housing (Aurangabad) Finance Ltd. and atu/June.2016

Cri.WP.No.1155.09 & 800.10.odt Chandrakant Kishanrao Dahale and others. The order passed by the Court dated 03.12.2014 appears on page No.3 of Exhibit-109 which is taken on record and marked as Exhibit "X" for identification. 2.

Mr.Joshi learned Advocate appearing on behalf of the petitioners in the both these matters submits that in terms of prayer clause '6' of Exhibit X and the order dated 03.12.2014 passed by the learned Court, both these petitions can be allowed in terms of prayer clause 'B'.

Learned Advocate for the respondents submits on instructions that both these petitions be allowed in terms of prayer clause 'B' in the light of the terms of Exhibit 'X'.

In the light of the above, both these petitions are allowed in terms of prayer clause 'B'.

Rule is made absolute in the above terms.
