It is submitted that, the validation proceeding in respect tribe claim of the petitioner is pending with the Committee since 2008. It is not decided.

The learned Assistant Government Pleader on instructions states that, the validation proceeding in respect of the Tribe claim of the petitioner is still pending.

Since 2008 the validation proceeding is pending with the Committee. The committee shall take steps to dispose of the validation proceeding expeditiously. The petitioner shall cooperate in expeditious disposal of the said proceeding. Till the

2 wp 11166.17 validation proceeding is decided, the employer shall not take any adverse action against the petitioner only on the ground that validation proceeding is pending.

Of course, the respondent/employer is entitled to take further course of action on the basis of judgment that would be delivered by the respondent No. 2/Committee. The writ petition is disposed of. No costs.
