DATED : 17th November, 2017 PER COURT : - The applicant, who is custodian of about 10 year old daughter, is seeking transfer of Hindu Marriage Petition 98 of 2016, from the Court at Kandhar to the Court at Pune, on the

mca157.17 ground that she is residing at Pune with her parents for her service purpose. The issue of hardship and inconvenience is sought to be canvassed.

The prayer is opposed by the respondent on the ground that all the efforts for restitution at the behest of respondent remained unresponded. According to him, the respondent is the only son looking after his parents. His hardship be also considered.

In the above backdrop, having regard to convenience of the wife, in my opinion, it will be appropriate to direct transfer of Hindu Marriage Petition No. 98 of 2016 pending on the file of learned Civil Judge, Senior Division at Kandhar to the Court of learned Civil Judge, Senior Division, Aurangabad and is accordingly directed.

Miscellaneous Civil Application stands allowed in above terms.
