Heard Mr. Ajinkya Kale, learned counsel for the applicant and the learned APP for the respondents/State.

The applicant is apprehending arrest in connection with Crime No. 350/2024 registered at Kopargaon Police Station, District Ahmednagar for the offences punishable under sections 420, 406, 465, 466, 467, 468, 471 r/w. 34 of I.P.C.

By order dated 9.10.2024 at para 1 this Court recorded as under :- "1.

Learned counsel for the Applicant submits that there are other crimes registered against Setu operators wherein the beneficiaries are not joined as accused. It is his submission that only for the reason that he did not respond to show cause notice as he met with an accident, he is arraigned as an accused." 4.

On this submission, the learned APP sought time to respond above submissions.

Today, the learned APP submits that the other beneficiaries are not joined as accused and as the present applicant has not responded the show

ABA 1539/24 cause notice, he was made accused. Considering the above submission, I hold that the applicant is entitled to anticipatory bail. 6.

In view of the above, the application is allowed and the interim protection granted by this Court vide order dated 9.9.2024 is confirmed on the following terms :

i] The applicant shall attend the police station as and when required.

ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
