I have heard the strenuous submissions of the learned Advocate for the petitioner and the respondents.

Learned Advocate for the petitioner submits, on instructions, that considering the provisions under Chapter II of the Maharashtra Public Libraries (Recognition for Grant in aid and Building and Equipment Grants) Rules, 1970 ("Rules of 1970"), in relation to recognition of public libraries, an inspection is carried out every year. Presently, respondent No.4 is operating a library. It is, therefore, submitted that the petitioner desires to withdraw this petition and apply to the competent authority for seeking recognition for operating the petitioner library. Such representation may be decided on its own merits.

Learned AGP for respondent Nos.1 to 3 submits that if the petitioner makes a representation under the provisions of the Rules of 1970 after curing all deficiencies, the said representation, would be considered on its own merits and strictly in accordance with the scheme that may be in vogue at the relevant time.

In the light of the above, this petition is disposed off as withdrawn, with liberty as prayed for. Needless to state, the competent authority acting under the Rules of 1970 would consider the representation / application of the petitioner and would hear all concerned parties, including respondent No.4 before taking any decision.
