Heard learned counsel for the applicant. The respondent despite service, remained absent.

The applicant is seeking transfer of HMP No.163 of 2022 fled by respondent husband for getting divorce, from the Court of 3rd Jt. CJSD, Nashik to 2nd Jt. Civil Judge (S.D.), Aurangabad. 3.
According to the applicant, she is not having any independent source of income and she has also fled proceeding in the aforesaid court at Aurangabad for restitution of conjugal right. 4.
Thus, it appears that since the respondent will have to attend the dates of the proceeding fled by the applicant at Aurangabad, the proceeding fled by him at Nashik can be conveniently transferred as prayed by the applicant. Hence, following order.
ORDER
(i) The application is hereby allowed.
(ii) The HMP No. 163 of 2022 pending in the court of 3rd Jt. CJSD, Nashik is transferred to 2nd Jt.
2 957 mca 265-22 CJSD, Aurangabad for its simultaneous disposal alongwith HMP NO. 277 of 2022 according to law.
(iii) The respondent is directed to appear before the 2nd Jt. Civil Judge S.D., Aurangabad on or before 09/01/2023.
