Heard learned Advocate appearing for the applicant. It is submitted that the trial Court as well as the appellate Court failed to consider the defence raised by the applicant in its proper perspective. It is further submitted that the cheque amount alongwith cost has been deposited with the complainant bank.

In that view of the matter, there is no impediment in the considering prayer for bail, hence order :

ORDER

1.

Criminal Application is allowed.

2.

The substantive sentence imposed by Judicial Magistrate First Class, Ahmednagar, District Ahmednagar in S.C.C. No. 3143/2015 is hereby suspended.

3.

Pending hearing and final disposal of the Criminal revision application, the applicant be released on bail subject to furnishing P.R. Bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with Surety Bond of like amount.

4.

Bail be furnished before the trial Court within the period of three weeks from the date of this order.

5.

Application is accordingly disposed off.
