PER COURT :- 1.

Both the learned Advocates jointly submit on instructions that the matter has been settled between the parties. The judgment of the Labour Court dated 21.8.2009 and the judgment of the Industrial Court dated 31.8.2013 shall be complied with by paying 50% of the backwages to the respondent / employee with continuity in service along with reinstatement. By consent, direction No.4 of the Labour Court, in it's order dated 21.8.2009 is, therefore, modified to the extent of the settlement between the parties. 2.

In the light of the above, this petition is partly allowed to the extent of the modification in the terms of the settlement between the parties as recorded in the foregoing paragraph.

The petitioner has deposited an amount of Rs.20,59,009/- in this Court towards back wages upto February 2016. It is jointly submitted that the respondent shall accordingly, withdraw 50% of the said amount from this Court and the petitioner / management shall pay him 50% of the wages for the months of March & April 2016 & upto 14.5.2016. The respondent shall be reinstated in service w.e.f. 15.5.2016. The remainder amount shall be withdrawn by the petitioner from this Court.
