Heard Mr Gatne, learned counsel for the applicant and Mr A.N. Bhosale holding for Mr A.T. Kanawade, learned counsel for respondent No.1. 3.

None present for respondent Nos. 2 and 3 though they are duly served with notice.

On going through the application, it is revealed that there was delay of 20 days in preferring the appeal.

Having regard to the nature of dispute and for the reasons stated in the application for condonation of delay para No. 3, the delay needs to be condoned.

ORDER

(i) The Application is hereby allowed in terms of prayer clause (B). (ii) The Registry to make scrutiny of the appeal as per the procedure and it be numbered and placed before the Court for final disposal at admission stage.

(iii) The Civil Application is accordingly disposed of. (iv) The appeal be listed on 17.02.2022.
