Applicants, who are original defendant Nos. 1 and 2, have filed this application to stay execution, operation and implementation of judgment and decree dated 03/04/2018 passed by the District Judge-1, Ahmednagar in Regular Civil Appeal No. 335 of 2012 and Regular Civil Appeal No. 336 of 2012, pending hearing and final disposal of the Second Appeal No. 124 of 2019, filed by them, aggrieved by the said judgment and decree passed by the District Judge-1, Ahmednagar.

Heard learned advocates appearing for the applicants and original plaintiff Nos. 1 and 3. 3.

The Second Appeal filed by the applicants is

( 2 ) ca12770.18 admitted for the substantial questions of law recorded in the separate order passed by this Court.

Considering the same and the grounds mentioned in the application, execution, operation and implementation of the judgment and decree dated 03/04/2018 passed by the District Judge-1, Ahmednagar in Regular Civil Appeal No. 335 of 2012 and Regular Civil Appeal No. 336 of 2012 is stayed pending hearing and final disposal of the Second Appeal. Application is thus allowed.
