Heard the learned counsel for the applicants and the learned A.P.P. for the respondent.

The applicants seek bail in C.R.No.037 of 2024 registered with Balwandi Police Station, Taluka Shrigonda, District Ahmednagar, for the offences punishable under Sections 302, 452, 506, 120B read with Section 34 of the Indian Penal Code and Sections 4, 25 of the Arms Act.

The prosecution has a case that two unknown persons came to the house of the deceased and they cut his neck, due to which he died. Initially, the first information report was lodged by the wife of the deceased. However, subsequently, she was also arraigned as an accused.

It has been alleged against the applicants that they were the contract killers. They had no reason to visit the place of the incident. However, the nephew of the deceased saw one of the coaccused Rohit going towards Pune with two unknown persons. When he gave call to Rohit, instead of stopping, he speeded his bike. The applicants have been arrested. Another eyewitness is the father of the deceased. However, he did not see them. 5.
Admittedly, no incriminating material has been recovered from the applicants. They have been arraigned as an accused only on the statement of the nephew of the deceased. 6.
In view of the above facts and there is no incriminating evidence against the applicants, it would unjustifiable to keep them behind bar. Hence, they deserve bail.
ORDER
I) The bail applications are allowed.
ii) Applicant - Prutviraj Anil Salve, in B.A.No.1669 of 2024, and Applicant - Viraj Satish Gade, in B.A.No.1677 of 2024, be released on bail, on furnishing PB and SB of Rs.50,000/- each, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) They should not tamper with the prosecution witnesses. (b) They should attend the trial on each effective dates. ( S. G. MEHARE, J. ) rrd
