This application has been filed for condonation of delay of 300 days caused in filing the first appeal.

Learned advocate for the applicant submits that the time to get approval for filing appeal from the higher authorities was consumed and thus the delay is caused, which is not deliberate or intentional and therefore, he prays to condone the delay. 3.
Learned advocate for respondent No.1 strongly objected the application by submitting that no substantial reason is assigned to condone the delay.

On perusal of application, it appears that the time was consumed in obtaining the approval from the higher authorities for filing appeal and thus the delay is not intentional or deliberate. The application therefore, deserves to be allowed in the interest of justice and it is accordingly allowed in terms of prayer clause "A". (SANJAY A. DESHMUKH, J.) rlj/
