I have heard the learned counsel for the Petitioner and the learned AGP on behalf of Respondent Nos.4, 5 and 6. The grievance is that Respondent No.6, who had granted status-quo in favour of the Petitioner on 23.01.2018, had vacated the status-quo by order dated 21.08.2018 on the belief that the Petitioner is prolonging the matter. Pursuant to the said order, the concerned Authority has closed the matter for passing final orders on RTS Appeal No.6/2018.
The learned AGP submits that he has obtained the record and proceedings in the matter. Though the appeal is closed for passing orders,
*2* the said authority is yet to deliver any order. The learned AGP further submits that Respondent No.6 has no grievance as regards hearing the Petitioner and there is no difficulty for the said authority to hear the Petitioner, but for the absence of the Petitioner. He, therefore, submits that if the Petitioner appears before the said authority on 08.10.2018, Respondent No.6 would hear the Petitioner as well as all other litigating sides by issuing appropriate notices to them. The learned counsel for the Petitioner submits that he has no difficulty in preparing the written notes of arguments accompanied with the judgments that he desires to cite and these documents will be placed before Respondent No.6 on 08.10.2018.
The learned AGP submits that as none of the revenue authorities have any bias or prejudice against the Petitioner, the revenue entries would not be made final until the Petitioner is heard on 08.10.2018 followed by the order of Respondent No.6. Considering the above and upon noting the statements made, this Writ Petition is disposed of.
It is made clear that the Petitioner shall appear before Respondent No.6 on 08.10.2018 at 12:00 noon and shall also enter the written notes of arguments along with citations, if any. No adjournment would be sought by the Petitioner under any circumstances.
