IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.10624 OF 2018 SANJAY BHARATLAL JAISWAL
VERSUS
SUNITA SURESHLAL JAISWAL AND OTHERS ...
Mr. M. P. Nikam, Advocate for the Petitioner. Mr. Amit Vaidya h/f Mr. N. S. Takale, Advocate for Respondent No.1.
...
CORAM : SHARMILA U. DESHMUKH, J.
DATED : 07th FEBRUARY, 2023.
PER COURT:- 1.
Learned counsel for the parties submit that the dispute has been settled amicably between the parties and consent terms would be filed before the Trial Court. 2.
Learned counsel for the petitioner submits that by an order of this Court dated 24.09.2018 further proceedings in the Trial Court were stayed. However, he expressed an apprehension that, in event the writ petition is disposed of, the interim order would also be vacated and as such, he would be left remedyless. 3.
The anxiety of the learned counsel for the petitioner can be taken care of by granting liberty to the petitioner to approach this Court, in event the consent terms are not filed before the Trial Court on account of default on the part of the respondents. In such case, the writ petition will stand revived and the order dated 24.09.2018 will also be revived. 4.
Writ Petition is disposed of in the above terms. (SHARMILA U. DESHMUKH) JUDGE Devendra/February-2023
