The parties in the application were referred to mediation. With the efforts of learned Mediator the parties have arrived at the settlement and they have already executed terms of settlement which is taken on record and marked as ' X' for identification. Petitioner No.1 i.e. husband and respondent No.1 i.e. wife are present before this court. They have accepted the terms of settlement and about terms there is no dispute. Both the learned advocates submit that as per the compromise both the parties have decided to reside separately.

Petitioner No.1 to deposit Rs.2,00,000/- for his son till he becomes major in addition to that he will deposit Rs.1000/- per month for son.

In view of the same, parties have decided not to prosecute each other and accordingly other proceedings are withdrawn against each other except complaint in PWDVA No. 9/2022 filed in the court of JMFC, Parbhani against which the present application is filed.

In view of above position, the criminal application is allowed in terms of prayer clause-B.
