Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers. 2.

The Applicant is apprehending arrest by the Khultabad Police Station, in Crime No.232/2025 registered for the offence punishable under Sections 318(4), 319(2), 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3 and 5 of the Maharashtra University, Board and Other Specified Examinations (Prevention of Malpractices) Act, 1982.

The above-referred Crime is registered on the report lodged by one Satish Ramchandra Borse, who is working as an Assistant Section Officer in the Yashwantrao Chavan Maharashtra Open University,

The case of Prosecution is that, in the supplementary examination for the Master of Arts Degree conducted during December 2024 and January 2025, the President and the Secretary of the Kohinoor Education Society, Khuldabad were the examinee for the examination, however, the Teachers from the said Institution appeared for the examination and solved the papers. Thus, there was impersonation in the said examination.

In all, six persons are made Accused in the said Crime. The Applicant was assigned with the duty as Center Coordinator of the said course. The Accused, who had appeared in the said examination for the President and the Secretary of the Institution, came to be arrested and released on bail. One co-accused, who was working as a Laboratory Assistant in the said Institution, has been protected by the learned Sessions Court. The accusation against the Applicant is that, he has assisted in the said Crime. How, it is not shown. The copies of the documents show the nature of duties assigned to the Applicant. The examination papers are already seized.

The investigation is almost over. The Applicant was protected by an interim order dated 08.09.2025. It is informed that, the Applicant attended the concerned Police Station and cooperated with the Investigating Agency. In this view of the matter, I am inclined to

ORDER

[i] The interim protection granted to the Applicant by this Court vide order dated 08.09.2025, is confirmed. [ii] The Application stands disposed off.
