The petitioner is objecting to the order passed by the Maharashtra Administrative Tribunal, rejecting the Original Application tendered by him bearing No.811/2016. The petitioner contends that out of three posts for Smithy Instructor, one post for was reserved for S.T. category and the same was not filled in and the petitioner belonging to D.T. category has been considered as an open category candidate. The petitioner says that, since the post for S.T. category has not been filled in for want of candidate belonging to reserved category, the claim of the petitioner ought to have considered since he belongs to one of the reserved categories. It must be noted that the reservation

2 WP 10824-17 prescribed for S.T. category is not inter changeable with any other categories, such as D.T. or N.T. The petitioner cannot claim any precedence on the strength of his belonging to D.T. category. There was no post earmarked for the aforesaid category and as such, the petitioner can not claim any preference. The view taken by the M.A.T. is reasonable and proper and does not call for any interference in exercise of powers under Article 226 of Constitution of India. 2.

Writ Petition is devoid of merits and as such stands disposed of.
