The applicants seek withdrawal of amount deposited in both the appeals to the tune of Rs. 91,43,908/-, cumulatively for both appeals. 1/2

The learned counsel for the applicants submits that the enhancement is very modest and lesser than four times. They are praying for disbursement of the entire amount.

As against that learned counsel Mr. Swami at the instance of the respondent-acquiring body submits that the acquired land is a dry land. An exorbitant amount is awarded. It is submitted that compensation is granted for land as well as trees which is arbitrary. 5.
Considering the rival submissions of the parties, the equities can be balanced by permitting the applicants to receive 75% of the amount with accrued interest thereby with holding 25% of the amount. 6.
The Civil Applications are partly allowed permitting the applicants to receive 75% of the amount with accrued interest on furnishing usual undertaking. Balance amount shall be invested in any nationalized Bank. 7.
The Civil Application No. 3722/2025 is not pressed and it is disposed of.
