In view of the above, the impugned order dated 04.02.2016 rendered by the learned Joint Civil Judge Senior Division, Nanded, below Exhibit-31 in Special Civil Suit No.6 of 2006 for referring the matter to the Arbitrator, does not survive. The same is accordingly quashed. Resultantly, the writ petition stands disposed of.
