Looking to the nature of the prayers this Court finds that, no prejudice would be caused to other side if the order is passed in the application.

The learned advocate for the applicants invites attention of this Court to the order passed by this Court dated 24.01.2025 in

2 913-CA 10678-2025.odt Civil Application No. 7913/2022 in Writ Petition No. 762/2006. This Court has granted permission to withdraw an amount of Rs. 96000/- deposited in the office of this Court along with accrued interest till date. By way of this application, the only modification sought is that the applicant No. 1 be allowed to withdraw the entire amount of Rs. 96000/- along with accrued interest. The applicant has annexed to this application consent letters by applicant Nos. 2 and 3 in favour of applicant No. 1. 5.

In this view of the matter, this Court finds that, the application can be allowed. Hence, following order :

ORDER

(I) The civil application is allowed.

(II) The applicant No. 1 is permitted to withdraw entire amount of Rs. 96000/- along with accrued interest pursuant to order dated 24.01.2025 passed in Civil Application No. 7913/2022. (III) With this, the civil application stands disposed of. ( KISHORE C. SANT, J. ) P.S.B.
