Petitioner filed Writ Petition No. 9880 of 2025 for direction to Respondent No.2 - Committee to decide Tribe claim of the Petitioner, as he had appeared in Medical Entrance Examination and rounds of counseling and admissions were to begin from 18th August, 2025.

Taking into consideration the fact that the father of the Petitioner was granted validity on the strength of an order passed by this Court on 25th March, 2019, in Writ Petition No.

{2} 7279 of 2011 ("Ganesh Dhondu Baviskar V/s The State of Maharashtra and Others"), this Court directed the Committee to decide Tribe Claim of the Petitioner on or before 31st August, 2025. As the Tribe Claim of the Petitioner is yet not decided, the present Contempt Petition is filed.

Learned Advocate for the Petitioner submits that the petitioner is given provisional admission in Lokmanya Tilak Medical College, Mumbai and he has to submit the validity certificate on or before 8th September, 2025 and if he fails to submit validity certificate on or before 8th September, 2025, his provisional admission would be cancelled.

Learned AGP submits that they have sought review of the order passed in Writ Petition No.7279 of 2011. He, therefore, submits that the validity certificate to be issued to the Petitioner be made subject to the decision of the said review application. 5.

It is well settled that once the High Court grants validity certificate in favour of father, the Committee has to issue the validity certificate to son also. We, therefore, direct the Committee to decide the claim of the Petitioner on or before 8th September, 2025 and issue validity certificate, so as to enable the petitioner to submit it before the College.

We make it clear that, the validity certificate to be issued in favour of the Petitioner shall be subject to the decision in the Review Application, filed by the Respondents. 7.
