Learned counsel Mr. Kotkar, on instructions, submits that the High Court Bench at Nagpur in Contempt Petition No.264 of 2015 has decided the issue involved, whether the Commissioner appointed under the Persons with Disabilities (Equal Opportunities, Protection of Right and Full Participation) Act, 1995 is not Court for the purpose of Contempt of Courts Act and in view of this he wanted to withdraw the proceeding with liberty to file appropriate proceeding.
