Mr.Jadhavar, learned counsel for the petitioner states that the validation proceedings in respect of the tribe claim of the petitioner as belonging to Tokre Koli - Scheduled Tribe is pending with the Committee, still, the employer has issued show cause notice to the petitioner to submit the validity or else further action would be taken.

Learned A.G.P. on instructions states that now the matter is kept before the Committee on 3.2.2017. The Vigilance report is also received.

In light of the above, we pass the following order :

a) The Respondent Committee shall decide the validation proceedings in respect of the tribe claim of the petitioner expeditiously, preferably within six (6) months. The petitioner shall cooperate in expeditious disposal of the said proceedings. The petitioner shall appear before the Committee on 3.2.2017 i.e. the date fixed for hearing.

b) Till the validation proceedings are decided, the Respondent Nos.3 and 4 shall not take adverse action against the petitioner only on the ground that validation proceedings are pending. The employer i.e. Respondent Nos.3 and 4 can take further course of action depending upon the judgment delivered by the Committee in the validation proceedings.
