PER COURT :- Heard the learned counsel appearing for the parties.

Perused the affidavit in reply filed by the Chief Executive Officer and the contents of the communication addressed to the petitioner by the Chief Executive Officer. We are satisfied that, the order of which the disobedience has been alleged, is complied with. Hence the Contempt Petition stands disposed of.

The learned counsel appearing for the petitioner invited our attention to the letter written by the District Heath Officer, Zilla Parishad, Ahmednagar and submits that, one of the ground for issuing such notice/

564.15CP communication is that, the petitioner filed Writ Petition in the High Court without seeking prior permission of the Chief Executive Officer, Zilla Parishad, Aurangabad. According to the learned counsel appearing for the petitioner, issuance of such notice on the aforementioned ground is objectionable and contrary to the legal position, and therefore, the same is required to be interfered with. In that respect, we do not want to express any opinion, since already we have disposed of the Contempt Petition. However, it is for the petitioner to take appropriate remedy in that respect.
