ORAL ORDER :

The petitioners had sought to produce the record of Regular Civil Suit No. 369 of 1981, more particularly, the map prepared pursuant to the measurement carried out on 27 March 1993 and also to examine the Surveyor, who prepared the map. 2.

The Surveyor has now long since retired from service. Therefore, the learned Judge was right in not issuing the witness summons to him. As regards the map of the earlier suit is concerned, the petitioner is not prejudiced by the impugned order as all the contentions of this petition based on this map produced, are kept open to be urged at the time of hearing of the suit. 3.

With this clarification, the writ petition is disposed of. N.M. Jamdar, J.
