DATE : OCTOBER 07, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0169 of 2022 registered with Ausa Police Station, Dist.Latur, for the offences punishable under Sections 307, 341 and 504 read with Section 34 of Indian Penal Code. 2.
Heard learned counsel appearing for the parties. 3.
The applicant is alleged to have stabbed the informant with knife. The FIR has been lodged by the informant himself. It is his case that the applicant and the co-accused intercepted the informant at Qureshi Galli, Ausa, by 06.00 p.m. on 17.05.2022. The applicant stabbed him with knife. He was, therefore, admitted to hospital.

Learned APP objects to grant the applicant bail on the ground that it was bid on the life of the informant. It was stab on the vital part namely, stomach of the informant. He would further submit that the trial court may be requested to expedite hearing of the case.

Perused the FIR and related papers. The informant was indoor patient for five days. He is said to have resumed all his daily pursuits. The applicant is in jail from 18.05.2022. He is just 22 years of age. On investigation, charge sheet has been filed. The applicant has no criminal antecedents. It will take time for commencement and conclusion of the trial.

In view of the above, the Court is inclined to grant the applicant bail. Hence, the following order:- (i) The application is allowed.
(ii) The applicant be released in connection with Crime No.0169 of 2022 registered with Ausa Police Station, Dist.Latur, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount, for the offences punishable under Sections 307, 341 and 504 read with Section 34 of Indian Penal Code.
12-BA.1653.2022 (iii) The applicant shall not tamper with the prosecution evidence.
