I have heard the learned Advocates for the respective sides. The Applicants pray for condonation of delay of 401 days caused in approaching this Court for bringing themselves on record as the sole Petitioner has passed away. Applicant No.1A is the widow of the deceased employee. It is submitted that they are poor and have no source of income.

In view of the peculiar facts as above, this Civil Application is allowed, subject to the Applicants paying an amount of Rs.500/- (Rupees Five Hundred) as donation for the Ghati Hospital, Aurangabad (Government Medical College and Hospital, Aurangabad), to be deposited

*2* 934ca14627o18 with the Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft, to be drawn in the name of "Dean, Government Medical College and Hospital Dengi Samiti, Aurangabad" and producing a receipt of such deposit before the Registry of this Court on or before 20.12.2018. Subject to the above, the Applicants be brought on record on or before 21.12.2018.

If the above direction is complied with, list Writ Petition No.3497/2009 for final hearing on 10.01.2019 in view of the judgments delivered by this Court in Writ Petition No.2617/2008 (Zilla Parishad, Nanded vs. The State of Maharashtra and another) decided on 08.05.2018 and Writ Petition No.3502/2009 (Gopinath Narsingrao Biradar vs. Zilla Parishad, Nanded) decided on 13.06.2018. kps (RAVINDRA V.
