In view of the above, this petition is disposed of as withdrawn. 3.

Since the suit is more than five years old, an order of expediting the suit cannot be passed. Hence, it is left to the litigating sides to request the Trial Court, at the time of recording of oral evidence, for giving precedence for this matter and the Trial Court would consider such request depending upon its pendency of cases.
