Leave to correct the amended prayer clause (B) by mentioning "Court of CJSD, Latur" instead of "Family Court, Latur". Heard learned Counsel for the applicant - wife. The respondent husband, though served, but remained absent. 2.

The applicant - wife is seeking transfer of Marriage Petition No. 367/2022 pending in the Family Court, Aurangabad filed by respondent - husband for restitution of conjugal rights, to the Court of Civil Judge (Senior Division), Latur.

According to the applicant-wife, she is not having any independent source of income. The distance between Latur and Aurangabad is about 300 kms. Moreover, she has also filed proceeding under Section 125 of Cr.PC. against the respondent - husband at Ahmedpur and the respondent has

(2) 969 MCA-263.2022.odt already appeared there. There is no oppose to the present application. Further, the respondent will have to attend the dates at Ahmedpur, District Latur in the proceeding filed by the applicant. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) Marriage Petition No. 367/2022 pending in the Family Court, Aurangabad is transferred to the Court of Civil Judge (Senior Division), Latur for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Latur on or before 01.08.2023.

(iv) The application is disposed of accordingly.
