The issue involved in the present writ petitions is no longer res-integra and is covered by the decision rendered by this Court in Writ Petition No.4536/2014 decided on 14.8.2014 and other connected petitions.
Petitioners claim to belong to Manervarlu, scheduled tribe. The tribe certificates issued to them recording entry in respect of the tribe were referred for verification to the scrutiny committee and the scrutiny committee has directed invalidation of the tribe certificates with liberty to petitioners to secure proper certificate and present the same for verification.
{3} Under the circumstances, we pass following order: The petitioners will approach the scrutiny committee with a request to issue a photostat copy or certified copy of the tribe certificates already issued to them and submitted for verification.
On receipt of photostat copy/certified copy of the tribe certificates, petitioners shall approach the concerned Sub Divisional Officer with an application for issuance of tribe certificate, recording correct spelling of the concerned tribe in consonance with the Constitutional Order and on presentation of the application, the Sub Divisional Officer, taking into consideration certified or photostat copy of the certificates issued earlier, shall issue correct tribe certificates, without embarking upon further enquiry into the matter within a period of one week from the date of approach of the petitioners.
{4} preferably within a period of six months from the date of presentation of the proposal and photostat copy of the tribe certificates. The scrutiny committee shall not reject the proposal for verification of tribe certificate on any technical ground and shall decide the matter on merit.
