This is an application for regular bail. The applicant herein was arrested on 21st August 2015 in Crime No.I-111/2015 registered at Begumpura Police Station, Aurangabad for offences punishable under Sections 376, 313, 504, 506 read with Section 34 of the Indian Penal Code, for the incident of the same date.

The allegations against the present applicant are that he is real brother of main accused Ajay and son of Latabai. Ajay, according to
Cri.Appln.No.5238 of 2015 victim had promised to marry her and has established physical relationship resulting into her termination of pregnancy. 4.
The role attributed to the applicant is that he has used abusive language against the complainant, when she visited the place of residence of the applicant.

Perused the case papers, but for the passing allegations aginast the applicant, there is no specific role attributed to the applicant in the crime. The investigation is at very advanced stage and as such, the custodial interrogation of the applicant will be hardly any assistance to the investigating agency. In view thereof, the applicant is entitled for bail. Hence, I proceed to pass the following order. 6.
The applicant Mukesh Murlidhar Mokale in connection with Crime No.I-111/2015, registered at Begumpura Police Station, Aurangabad for offences punishable under Sections 376, 313, 504, 506 read with Section 34 of the Indian Penal Code, be released on bail, upon furnishing P.R. Bond of Rs.15,000/- (Rs. Fifteen thousand) along with one surety in the like amount.
