We have heard Mr. Dharurkar, learned counsel for the petitioner and learned AGP.

The petitioner has approached this Court being aggrieved by the non-grant of interim order. The petitioner had filed application for study leave with the respondent. The said application is not decided. The petitioner approached the Maharashtra Administrative Tribunal by filing Original Application and by way of interim order prayed for direction to decide his application.

It is the submissions of the learned counsel for the petitioner that course commenced

( 2 ) wp10574.18 from 01.09.2018 and the Institute where he has got admission has threatened to cancel the admission. 4.

We have heard learned AGP.

The Tribunal has refused the interim order on the ground that same would tantamount to passing the final order. In such matters it is expected by the respondent to decide the application filed by the petitioner for study leave expeditiously. The application is filed in May, 2018. It was expected from the respondent to take decision upon the said application on its own merits within short time. 6.

The respondent/Competent Authority shall decide the application filed by the petitioner for study leave on its own merits under any circumstances within 10 days from today.

With these observations, the writ petition is disposed of. No costs.
