This is an application for grant of regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No.214 of 2025, registered at Bori Police Station, District Parbhani, for the offences punishable under Sections 108, 85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The learned advocate for the applicant pointed out the report wherein the informant, who is the brother of the deceased Vandana, alleged that his sister was married with the applicant in the year 2012. From the said wedlock, they were blessed with two sons, namely, Vedant, aged 11 years, and Shivraj, aged 9 years. It is alleged that the

(( 2 )) 39 BA NO. 1722 OF 2025 applicant frequently beat Vandana. The informant and his relatives tried to give understanding to the applicant, but he continued to harass Vandana by not providing her food on time, making her work in the field without food, keeping her separately in a room, abusing her, and assaulting her over small matters. The applicant also demanded Rs. 1,00,000/- from her for building a house. Because of the continuous harassment, Vandana committed suicide by hanging.

The learned advocate for the applicant submitted that the applicant has been falsely implicated in the crime and the allegations made against him are vague and general in nature. He pointed out the medical papers showing that Vandana was undergoing treatment prior to her death and was suffering from an illness of Straightening of Cervical Spine likely due to muscular spasm. It is submitted that Vandana might have committed suicide due to her illness. The applicant has roots in the society and he will not flee away from the trial. The practical investigation is over. The trial will take a long period. It is lastly prayed to allow the application. 5.

The learned APP for the State strongly opposed the application and submitted that the applicant is involved in a serious crime. It is alleged that he harassed and ill treated his wife for non-fulfillment of the demand of Rs.1,00,000/-, which drove her to commit suicide. It is lastly prayed to reject the application.

Perused the charge sheet, particularly the report, statements of witnesses and the post mortem report. The marriage between the applicant and the deceased took place about 12 years prior to the incident. The applicant has roots in the society and he will not flee away from the trial. The practical investigation is over. The trial will take a long period. The application, therefore, deserves to be allowed. Hence, the following order: ::ORDER::

I.

The application is allowed.

II.

The applicant, in connection with Crime No.214 of 2025, registered at Bori Police Station, District Parbhani, for the offences punishable under Sections 108, 85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, be released on bail on furnishing personal bond of Rs.25,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner.
