ORDER:

The petitioner is in IInd year BDS. The validation proceeding is presented. It is stated that, the nomenclature of the tribe in the tribe certificate is wrongly spelt. The result of the petitioner's IInd year BDS examination declared pursuant to the interim order passed by this Court.

Considering the above, we pass the following order.

ORDER

(i) The petitioner within one week shall apply to the Committee for return of the attested copy of the tribe certificate. The attested copy of the tribe certificate shall be issued by the Committee immediately. On receipt of the attested copy of the tribe certificate from the Committee, the petitioner shall submit the same to the concerned Sub-Divisional Officer within one week. The SubDivisional Officer shall issue the corrected tribe certificate to the petitioner within two weeks. On receipt of the tribe certificate, within one week the petitioner shall submit the corrected certificate to the committee. The Committee shall thereafter decide the validation proceeding within six months from the date of submission of the corrected tribe certificate.

(ii) The respondents shall allow the petitioner if eligible to prosecute the studies of third year BDS and shall be permitted to appear for third year BDS examination.

(iii) The respondents No. 3 and 4 may take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding.
