This is an application for granting regular bail under section 483 of Bhartiya Nagarik Suraksha Sanhita (BNSS), 2023 in connection with crime No. 73 of 2025 registered with Pachora police station, District Jalgaon, for the offences punishable under Sections 103(1), 3(5) of Bhartiya Nyay Sanhita, 2023.

Learned advocate for the applicant pointed out that the report in which the name of present applicant is not mentioned. His role is not specified in the report. It is alleged that the co-accused assaulted deceased Hemant by a knife and he died.

Learned advocate for the applicant has pointed out the supplementary statement of the informant, in which he has sated that

-2one of the co-accused handed over a knife, used for assaulting Hemant Sonwane to Nilesh Namdeo and he thereafter handed over it to the applicant and at the instance of applicant, the said knife is recoverd. Except that, there is no material against the applicant. He submitted that applicant is 19 years of old boy and he has no criminal antecedents. He has roots in the society. He will not flee away from the trial. The trial will take a long period. It is lastly prayed to grant bail to the applicant.

Learned A.P.P. for the respondent-State has strongly opposed the application and submitted that the applicant is involved in serious offence. A knife is recovered at the instance of the applicant under Section 27 of the Evidence Act. He therefore, prayed for rejection of the application.

Perused the charge sheet, particularly the report and the statements of witnesses. The supplementary statement of the informant discloses the name of the applicant. Further recovery panchanama of the knife shows that it is recovered at the instance of the applicant. However, considering his role, the application deserves to be released on certain conditions on the principle that the bail is rule and jail is exception. Hence, the following order.

Application is allowed.

II.

The applicant in connection with crime No. 73 of 2025 registered with Pachora police station, District Jalgaon be released on bail on furnishing personal bond of Rs.25,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner.

b) The applicant shall not enter in Pachora city, Tq. Pachora, district Jalgaon, till the conclusion of trial. (SANJAY A. DESHMUKH, J.) rlj/
